NAHMA HUD Update: HUD Issues Final Rule for PIH and MFH Rental Assistance Programs May 7, 2020

May 7, 2020

Dear NAHMA Members:

The Offices of Public and Indian Housing and Multifamily Housing published a final rule that includes regulatory language for PIH and MFH rental assistance programs.  This rule aligns the current regulatory flexibilities with those provided in the Fixing America’s Surface Transportation (FAST) Act.  The final rule implements the statutory provisions of the FAST Act and modifies the earlier streamlining regulations so the procedures for families meeting the 90% fixed-income threshold of the FAST Act are as similar as possible to those for families who receive less than 90% from fixed-income sources.  Also included are provisions around utility allowance reimbursement and family declaration of assets.

The Streamlining Administrative Regulations for Multifamily Housing Programs and Implementing Family Income Reviews under the Fixing America’s Surface Transportation

(FAST) Act final rule is attached and can be found HERE.

NAHMA provided comments to HUD on the interim rule in 2017.  A complete NAHMAnalysis of the final rule can be found HERE.
